Bail bond terms and conditions can be complex. Having a basic understanding helps ensure you comply with the agreement and avoid complications. Below are common terms to be aware of.
The bail bond premium is the fee charged by the bail bond company for its services. It is typically a percentage of the total bail amount and is non-refundable. The premium can vary depending on the state and the bail bond company.
Bail bond collateral is an asset used to secure the bail bond. It can be in the form of cash, property, or other valuable assets. If the defendant fails to appear in court, the bail bond company can seize the collateral to cover the bail amount.
The bail bond agreement is a contract between the bail bond company, the defendant, and the co-signer. It outlines the terms and conditions of the bail bond and the responsibilities of each party.
The co-signer is the individual who agrees to be responsible for ensuring the defendant appears in court. They are often a family member or friend of the defendant.
Bail bond forfeiture occurs when the defendant fails to appear in court as scheduled. If this happens, the court may issue a warrant for their arrest, and the bail bond company may be required to pay the full bail amount to the court.
Bail bond revocation occurs when the court determines the defendant has violated the terms of their bail bond agreement. This can result in the defendant being returned to jail and the forfeiture of the bail bond.
Some bail bond companies offer payment plans to help individuals pay the bail bond premium. These plans typically require a down payment and scheduled payments until the premium is paid in full.
If the case is not resolved by the scheduled court date, the bail bond may need to be renewed.
Bail bond exoneration occurs when the case is resolved and the bail bond is no longer needed. This can happen if the defendant is acquitted, the charges are dropped, or they are sentenced to time served.
